  • Representing employers and employees in state and federal courts and in arbitration proceedings on all employment-related claims, including harassment, discrimination, wrongful termination, violation of public policy, retaliation, defamation, breach of contract, and overtime violations.
  • Representing employers and employees in various wage and hours issues including disputes over commission plans, recovery of back wages, recovery of overtime wages, improper classification of employees, and recovery of penalties for missed meal and rest periods. We also perform full wage and hour compliance audits for businesses, including the categorization of employees as exempt or non-exempt, alternative workweek schedules, meal and rest periods, makeup time requests, and overtime requirements.
  • Preparation and updating of employment agreements, employee handbooks, and personnel policies governing the conduct, terms and conditions of the workplace and the employment relationship.
  • Counseling employers on all aspects of hiring, employee evaluation, disciplinary procedures, and termination of employees.
  • Counseling employers with respect to workplace privacy, employer monitoring, internal investigations, workers’ compensation, employee benefits, and health and safety in the workplace.
  • Advising employers regarding the protection of trade secrets and other proprietary company information and prevention of current and former employees’ unlawful use of such protected information.
  • Conducting training seminars to inform and educate owners, managers, supervisors, and employees about all aspects of employment practices and policies in the workplace.
  • Conducting internal audits of company employment practices, including those relating to discrimination, harassment, and wage and hour practices.
  • Assisting employers with investigations by government agencies and responding to claims filed by employees with such agencies, including the Equal Employment Opportunity Commission (EEOC), Fair Employment and Housing Commission (FEHC), and California Labor Commissioner.
  • Negotiation and preparation of executive compensation agreements, employee benefits plans, and severance and release agreements on behalf of employers and employees.
  • Preparation of independent contractor agreements, confidentiality agreements, and non-solicitation agreements to protect employers, employees, and independent contractors.
